By using Daitee and uploading content, you agree to these Terms and Conditions. If you do not agree with any part of these terms, please discontinue use of our service immediately.

2. Age Requirement

To access or use our Service, you must be at least 18 years of age or, if higher, the age of majority in your jurisdiction. If you are under this age, you are not permitted to access or use our Service. By accessing or using our Service, you affirm that you are at least 18 years old (or the age of majority in your jurisdiction) and fully competent to enter into and comply with our terms and conditions.

3. Account Termination and Suspension

We reserve the right, at our sole discretion, to terminate or suspend any account or restrict access to our Service at any time, without notice or liability, for any reason, including but not limited to a breach of these Terms of Service. This may include situations where your use of the Service is deemed to be harmful to other users, illegal, infringing on the rights of others, or acting inconsistently with the spirit or intent of our policies.

In the event of termination, you are still bound by the terms of these Terms of Service including the sections concerning indemnification and limitation of liability.

4. User Responsibilities

You agree not to upload any content that infringes on intellectual property rights, is illegal, offensive, or violates any laws. You are solely responsible for the content you upload and the consequences of uploading such content. Daitee and its affiliates take no responsibility for any infringement and/or damages resulting from uploading data.

5. Data Processing and Storage

• Our service processes user uploads but does not store or log them server-side.
• User data such as passwords and emails may be processed in multiple countries and is subject to international data transfer protocols. Transfers are always encrypted using best practices.
• We use OpenAI for anonymized data processing. Your data may be analyzed by OpenAI's systems, but your personal identity will not be disclosed. Please also refer to OpenAI's terms

6. Intellectual Property Rights

You retain all rights to the content you upload. However, by uploading content, you grant us a temporary license to use this content for the purpose of providing our services.

7. Disclaimer of Warranties

Our service is provided "as is" without any warranties of any kind, either express or implied, including but not limited to, implied warranties of merchantability or fitness for a particular purpose.

8. Limitation of Liability

Daitee will not be liable for any indirect, incidental, special, consequential, or punitive damages, or any loss of profits or revenues, whether incurred directly or indirectly, or any loss of data, use, goodwill, or other intangible losses.

9. Indemnification

You agree to indemnify and hold harmless Daitee and its officers, directors, employees, and agents from and against any claims, disputes, demands, liabilities, damages, losses, and expenses arising out of or in any way connected with your use of the service or violation of these Terms.

10. Amendments to Terms

We reserve the right to modify these terms at any time. We will notify users of any changes by posting the new terms on our service. Changes are effective immediately upon posting.

11. Governing Law

These terms shall be governed by the applicable law, without regard to its conflict of law provisions.

13. Single Sign-On with Google

Daitee offers Single Sign-On (SSO) as a convenience option, allowing you to sign in using your Google account. By choosing to sign in through Google SSO, you consent to our access of your email address and any other information made available to us through Google. We only collect and use your email address for account identification, communication, and service enhancement purposes. No other information is collected or used, including your first and last name.

Please be aware that your use of Google SSO is subject to Google's Terms of Service and Privacy Policy. We encourage you to review these documents to understand how Google collects, uses, and shares your information. By using Google SSO, you agree to allow us to receive information from Google that is necessary for utilizing the SSO functionality.

14. Supplementary Terms for Apple Users

In addition to the Daitee Terms of Service, users who access Daitee via Apple devices agree to be bound by Apple's End User License Agreement (EULA). This includes provisions on data use, licensing scope, termination policies, external services, and liability limitations. In case of any conflict, Apple's EULA will prevail for users on Apple platforms.
